インドで生殖医療の法整備に向けた動き
時事配信のニュースだけど、タイトルがちょっと変じゃないかな？
「合法化」「規制」というのとは、微妙にニュアンスが違うような気がする。
「野放し状態」というか法的にグレーだったので、法整備を進める動きが強まった、という感じだと思えるが。

【ニューデリー２７日時事】インド政府は２７日までに、代理出産を含む生殖補助医療に関する規則となる新法案をまとめた。代理出産について外国人が依頼するケースを含め、一定の条件下で合法化している。
インドでは、日本人男性の依頼を受けた女性が今年７月に女児を代理出産。ただ、現行法では女児は国籍を取得できず、出国できないでいる。この問題を機に、代理出産に関する法整備を求める声が高まっていた。
法案は代理出産について、依頼者と代理母との間で法的拘束力を伴う合意が必要と規定。依頼者が外国人の場合は、インド人の法定代理人を置いた上で、子供が出生後に出国できるよう事前に適正な準備を行うよう義務付けている。地元紙によると、法案は年内に国会に提出される見通し。（2008/09/27-17:39）

New Delhi, September 26 With the dust of the ethics debate and legal battle over Baby Manji ? born on July 25 to a surrogate mother in Gujarat using the sperm of a Japanese man and the egg of an unknown donor? yet to settle, the first move has been made in the direction of setting up a regulatory framework for surrogacy in India.Indian Council of Medical Research (ICMR) on Friday came out with a draft Assisted Reproductive Technology (Regulation) Bill, 2008, that said the surrogate baby of a separated or divorced couple will remain their “legitimate child” if both parties had consented to assisted reproductive technology (ART) to have the baby. The baby’s birth certificate will have the name(s) of the genetic parents/parent.
The draft Bill is expected to be tabled in Parliament’s winter session.
A foreigner or foreign couple not resident in India, or a non-resident Indian individual or couple seeking surrogacy in India, will have to appoint a local guardian who will be legally responsible for the care of the surrogate mother during and after pregnancy until the baby is delivered to the parent/parents or the local guardian.
